There are very good reasons for NOT formally declaring war. Those Detainees would be immediate POWs that have full Geneva convention protections along with the requirement that they be released at the end of hostilities. Do you want them released? I want them to rot on GITMO.

First you say that the US was in a state of war during the War on Tripolis even without an explicit declaration and now you are claiming that there actually is a distinction between the congressional declaration made by Congress so many years ago and this year. In other words, you've attempted to argue that the congressional declaration of this year is constitutional and puts us formally at war, but here you claim it really doesn't. LOL.
