seeks relief from the Court “Stay”, causing Deportations to be halted, while the Court engages in its delay No. The oral argument about to take place is about a stay preventing Trump from enforcing his Executive Order about birthright citizen.
To: numberonepal
This is why Trump has to be VERY careful about the deportations, and have a dang good reason (he does) for removing habeas corpus even for illegals.
Suspension of the privilege of the writ of habeas corpus is found in Article I which lists the powers of the Legislative branch. It is a Legislative power which which may be exercised directly by the Legislature, or they may delegate it to the Executive. No such power has been delegated to President Trump, nor is it likely to be delegated.
Ex Parte Bollman and Swartwout, 8 U.S. 75 (1807), Marshall, CJ
But this point also is decided in Hamilton's Case and in Burford's Case. If at any time the public safety should require the suspension of the powers vested by this act in the courts of the United States, it is for the legislature to say so.
That question depends on political considerations, on which the legislature is to decide. Until the legislative will be expressed, this Court can only see its duty, and must obey the laws.

And what if the Insurrection Act was invoked first, citing an incursion & invasion that threatened the nation?

The seeds are more nutritious than the juice.

Good article. Thank you, Pete. Since my consumption of fruity martinis is rather irregular, I’ll just put the pomegranate juice alone in a martini glass and enjoy it that way. I wouldn’t be interested in having alcohol every day, but the glass itself would make it more festive. The benefits, as reported, are noteworthy.

pomegranate AND PROSECCO is also very important to our health...

Haha! That’s a new one that sounds good. Prosecco is usually too sweet for me but would be an excellent balance to the tartness of the PJ. Great suggestion!

Of note, we find for POTUS, in that: [A] and yet: [B]
re: The Japanese Immigrant Case, 189 U. S. 86, 100-101 (1903)
[A] Now, it has been settled that the power to exclude or expel aliens belonged to the political department of the Government, and that the order of an executive officer, invested with the power to determine finally the facts upon which an alien's right to enter this country, or remain in it, depended, was "due process of law, and no other tribunal, unless expressly authorized by law to do so, was at liberty to reexamine the evidence on which he acted, or to controvert its sufficiency." Fong Yue Ting v. United States, 149 U. S. 698, 713; Nishimura Ekiu v. United States, 142 13. S. 651, 659; Lem Moon Sing v. United States, 158 U. S. 538, 547.
[B] But this court has never held, nor must we now be understood as holding, that administrative officers, when executing the provisions of a statute involving the liberty of persons, may disregard the fundamental principles that inhere in "due process of law" as understood at the time of the adoption of the Constitution.
