The question it seems to me is who exactly appointed Jackie. If it wasn’t legal then by definition the appointment was illegal. Who was it that broke the law, hmmmm?

Vacancy in presidency automatically makes VP president. ‘Swearing in’ is just ceremonial. The qualifications for VP are the same as for president. No one is going to seriously challenge a VP except via impeachment and removal.
I would argue he does.
Heck, he pretended to be a peace officer, when he was not (as US attorney).
Arrest him and put him in Florida prison.
