The law's not the problem here as much as judges hammering people with lengthy prison terms.

If you think the law is being misused, change the law. Otherwise, it's going to stand until changed or ruled unconstitutional.

And are these defendants receiving “time served” for their lengthy incarcerations?

I can only speculate on why those assembled whom I watched thought the inside of the Capitol would be accessible. It usually is accessible to the public, so they would have reason to think it would be open. If for no other reason, this was a cold winter day and they’d already been outside for many hours at the other end of town hearing Trump’s speech in person. Lovers of America came from all over the U.S. and even outside of the U.S. This group clearly were peaceful. Perhaps someone from the inside had come out and told them to wait and that the door would be opened. That’s my guess, based up the orderly line of patient people. I don’t know whether President Trump envisioned the peaceful rally he envisioned for the Capitol be inside or out. My guess is he envisioned it an outside rally, but you’d have to ask him. That people wanted to make their presence known inside the building, too, is not surprising. It was a darn cold day! One thing President Trump did specify explicitly, as we all heard, was that rally be peaceful.

In answer to your request, I’m pursuing finding exactly the footage I watched live. Perhaps it’s been censored by the Leftist censors, but I’ll keep trying to find that footage, if was ever posted after the live streaming real time reporting. I watched for a very, very long time - at least an hour and a half- a group of people assembled on a plaza outside a door in the Capital; they were forming an orderly line, clearly with the hope, and it seemed expectation that they would in time be able to enter the Capital building, which is generally open to the public.

They were NOT demanding to enter. They were simply waiting, with the group closest to the door, forming a line. They were peaceful. I did see even one person acting up. As I said, there were dads with school age boys among them.

Then a uniformed middle aged officer, clearly a guard/perhaps policeman, opening a door - it was one of those big wooden doors with the horizontal metal round bar that one pushes to make a door open in older public buildings/schools, etc. Once the officer had opened the door, he stood with his back against the open door to keep it open, as he motioned with his arm a welcome and indication that they should enter in single file - and that’s what they did. They were NOT storming the door; they were not entering through a window. They seemed energized, but not violent at all. The memory of that site is clear in my mind and I shall never forget it.
If and when I can locate that footage, if it’s not been censored from the web, I’ll definitely post it.

The following footage might be of interest, though. It takes place as events apparently on another side of the building were taking place - again peaceful. You will see that in the middle of a peaceful crowd, police, unprovoked, sent down eye-stinging tear gas, resulting in some of the peaceful crowd becoming rightly outraged. From the start of this set of footage, the reporters explain that the sensationalist anti-Trump media were totally mischaracterizing and outright lying about the nature of the protest and the protesters. So it’s clear that from the get go, the Leftist media had been given their marching orders to make listeners mistakenly think the crowd who came to the Capitol were trouble makers, insurrectionists, etc.

I omitted the word “not” in the previous post. “ They were peaceful. I did NOT see even one person acting up.”

Better to watch the reporter’s footage from the zero mark/the beginning, so you can hear the reporter’s take on the events so far that day and watch as things unfold and accelerate after police or someone lobbed tear gas down on the peaceful crowd. Again, this was almost certainly a different side of the building from the side I watched, where people were welcomed into the building by a guard/policemen.
