I have long thought that the best pathway for an attack on what social media is doing to conservatives is through the FEC. When they censor conservatives and Republicans, they are simultaneously becoming a super PAC, which carries certain reporting and conduct requirements, and providing a political contribution to one side, which carries additional requirements. They should be shut down until they comply with those requirements. This is the best way to support the freedom of private companies to have political beliefs while recognizing that what they are doing amounts to supporting a political party and treating it accordingly.
This is not to say that they shouldn’t also be attacked for antitrust violations and for violating the first amendment through the line of cases that recognizes that a private entity can become a public square. All of those avenues should be pursued. Nothing will be decided until cases get to the Supreme Court, and until Ginsberg is replaced, nothing is certain about how it will come out. Roberts is untrustworthy.
