Seems like a subjective standard from an enforcement standpoint, but then this defendant hasn't been charged with a gun crime to my knowledge...which in itself is interesting since he's been identified through testimony as the person who fired the first shots in the melee.
And I hope that justice prevails for those who were indicted and who are innocent of any crime. The blanket arrests of 170 people under the cover of "engaging in organized crime" with bail of $1million dollars. is criminal and the perpetrators of that injustice (the prosecutor's office) need to be punished with jail time too .
A couple of legal points:
The indictments all had to be identical, as they are all accused with an organized conspiracy.
Under TPC 71, there were certainly inditeable crimes.
So the charges and arrests were legal.
Were the charges smart or “just,” possibly no. That said, in the end, those who did not personally engage in violent acts or were not caught with major weight in drugs or were not the instigators of this were still in violation of the law.
They will end up pleasding to some low-level anatomist such as Staring With Intent To Gawk or Mopery in the 3d Degree, pay $100 and walk.

Let me tell you, "mr. supposedly know-it-all jerk", if I were there and got charged like this knowing I hadn't done anything at all, I wouldn't plead to anything!!! I'd sue for false arrest and anything else I could charge them with for causing such trouble in my life!
The problem is, under the law, they DID COMMIT A CRIME.
Please review Texas Penal Code Chapter 71 and others dealing with “conspiracy” for more information.
P.S I have no idea how the word “misdemeanor” became “anatomist”, but that was about the time one of our cats was walking over my desk in the keyboard area looking for his morning treat.
By the way, I think if we have polite conversations, not filtered through some persons best kindly described as “pressured”, you will find I am far from a “mr. supposedly know-it-all jerk”, but am rather an experienced person trying to bring some truth and rationality to a topic where some here simply repeat the wild blogs of random LEO haters and/or the equally wild claims of defense attorneys.
I would remind you that O.J’s lawyers, Casey Anthony’s lawyers, the Rosenberg’s lawyers, Joseph Goebbels, the layers for the convicted Buffalo Six Islamic terrorists, lawyers for Bowe Bergdaul, lawyers for Chelsea Manning, lawyers for Major Hassan, LEO hating FReepers and so many others simply repeated their lies enough that some inexperienced people believed them.
We are smarter than that.
