...and then there's the problem presented by the differing opinion not being an informed opinion.

District of Columbia Superior Court Judge John H. Bayly handed the verdict down because Finnerty waived his right to a jury trial.

Geez, Durham sure has a whole lot of corruption for a town its size.

This article is wrong. I don't care what it says, because it's wrong. Other articles stated Finnerty had no right to a jury trial.

And it wouldn't be the first time some journalist got it wrong, would it?
It was a misdemeanor trial. Under the law, he had no right to a jury trial.

Sex, Lies & The Media

EXCERPT

... The coverage of the case has often been irresponsible and sensationalistic, even at ostensibly responsible and sober media outlets. Journalists spend a lot of time lecturing bloggers about responsibility, but the mainstream media did far more damage to the Duke students than bloggers ever could. If traditional media outlets want to claim the mantle of legitimacy, they need to approach stories like this responsibly, particularly in light of the potential ramifications for those involved.

I count nine posts from you this morning. Tell me the part where you haven't been listened to. We've all heard you and we've all disagreed with you.

To the point, if Nifong had at least interviewed all the defendants and listened to their exculpatory evidence then he could at least say that he'd seen it and didn't agree with it.

"I wonder how unusual it is for an indictment to be brought down without ever having SPOKEN to ANY of the accused."
"I never saw it happen in the 32 years I was on the job."

It would probably be rejected as implausible for a fictional plot line of a made-for-TV movie.

Yes, and the minute you walk in with legal representation or say you will meet with them and talk WITH legal representation, the police file the charges (because you look guilty). The School Administration says you can't have a lawyer present, because they'd have to have one present, too (so, like, go ahead -- I'm sure you have one on retainer), and you're screwed either way, but at least your child didn't make a statement against their own best interests.

I'm telling you, any adult worth his salt can have your scared kid admitting to being on the grassy knoll in Dallas by the time they are done (and that was 20 years before your kid was born). We would have solved the conspiracy long ago, had we been able to interrogate kids.

I think the story is wrong, though and you're right.

No problem. This article clearly states Collin had no right to a jury trial under DC law.

Dear FReeper, that is EXACTLY how it works now. My husband and I sat there last night and this morning and felt like our words were coming out of stranger's mouths. That's exactly what we said, where we've been and what has happened. I'm not saying police are bad, but our system is broken. Wake up and smell the coffee, folks.

We'll be gone in a little while and you'll be left with the system the PC crowd has built for you. I hope you like it, cause it's the one we deserve.

I read some time back that one of the accused fathers is a cousin to Bob Bennett, but now I can't remember which one. Do you recall who it is? I imagine that he is certainly a silent adviser to the parents and this case.

I was not aware of the institutions right to coerce a statement from a student. I always told my children to never say anything until they consulted with me regarding any matter that might have serious consequences. I doubt that they always followed my instructions, but they will tell you that I did tell them to. They are adults now and out from under my control so they don't have to report those things to me, but I can tell you that one child when confronted with a serious situation called her father first before contacting anyone else.

I think Duke has some serious problems if they actually instructed the Lacrosse players not to contact their parents. That is very dangerous interference in the parent/child relationship, I believe.

I was thinking he's related to an unindicted player. Can't remember exactly which one.

It's John Walsh who is a cousin of Bennett.
