Why isn't it fair? Crystal isn't a party to the case. She's the complaining witness. That's why I think it's ridiculous when I hear the AV supporters saying that she "deserves her day in court." Well, no, she doesn't. It's not her case. She can bring a civil suit if she wants "her day in court."
The State is the party that's bringing the case against the three defendants. The State can't depose the defendants either.
Because I said so.....just kidding :-) Seriously, I do understand what you are saying. Yet it does seem unbalanced since the prosecution (via the investigator) had access.
Can the DA have "informal" meetings with her or supposedly is he to have no more offical contact until the trial?

FBI trainees raid high school student's computer for her blog comments :
"Still, the officers who interrogated Carter seemed to be bearing FBI credentials, Carter says. Both men wore FBI shirts, and one of them, Moore, gave her a business card with the FBI's official emblem on it. Carter showed The Independent the card she said she got from Moore. It reads: "FBI Cyber Crime Task Force" and "John W. Moore, Task Force Agent." . . .
"They'd come to see her, they said, because of an entry in her blog titled, "Somebody Hacked the Gibson." Moore and Walker wanted to know, what does that mean? Not much, Carter explained. "It's from the movie, Hackers," she says. Governor Mike Easley's Crime Commission announced Wednesday that it is offering a $10,000 reward for information to help identify the suspects of last week's cross burnings. The FBI added $5,000 to the award after the governor's initial announcement. CrimeStoppers issued a $1,200 reward, and Durham County Commissioner Lewis Cheek offered a $1,000 reward of his own-bringing the total reward total to $17,200.

"I think this is good publicity-the police and FBI being here. We will not tolerate this kind of mess in this town," he said.
In a statement released this week, Duke President Richard Brodhead said the incident was uncharacteristic of the Durham he has come to know.
"I join with others at Duke and in Durham in deploring the recent cross burnings," he said. "Such symbols of hatred... are anathema to values we hold dear in this diverse and caring community."
Duke instructor in cultural anthropology Susan McDonic, who attended one of three vigils at the cross-burning sites held last week, said she was impressed by how the city reacted to the incident. "The strong community response serves to resolidify my faith in humanity and focus on what is good in the community," she said.
(Right. Meanwhile, Durham cops beat up a black cook, and there is no FBI, no statement from Brodhead, no hundreds of demonstrators, no wanted posters, no rewards. )
Remember... I've never handled a criminal case from either side. And I'm not licensed in North Carolina.
I can't imagine why Nifong couldn't have contact with a complaining witness. And Nifong couldn't prevent her from talking to the defense. That would be her choice (but chances are slim to none that she would do it).
My guess is that the only time a conference with her would be discoverable is if it's with an investigator and it's reduced to a writing. I would think her conferences with Nifong would be privileged under work product.
What happened to the prosecutors who were posting here? Jezebelle will probably have something to add.

The problem at CTV, IMO, is that the moderator lets a group of people come in and insult and pick fights with the Purpose of disrupting the threads and changing the issue.
There are multiple posters, a whole pack, that don't ever make substantive comments, they just smart-off and attack.
I sent a PM to the MOD and asked her directly - why is this allowed to persist? The response I got was that if I responded to the attacks - I'd be banned. She didn't reply to any further PMs. Certain people over there are allowed to snipe and attack - and they have absolutely no other purpose.

This is ABSOLUTELY True! I've never seen another case where people make such far-fetched speculation in order to justify charges. I'm talking about the Media - not the authorities.
In 99.9% of cases, the discussion is whether there is reasonable doubt - the crazy scenarios are put forward by the Defense.
In this case, due to the PC affilation and the zeal to support this woman, most of the discussion if crazy possibilites that make it "possible" they commited the crime.
Show me another case where the media continually posited theories about DIFFERENT remotely possible theories where the defendants could have commited the crime even to the point the the person reporting the crime could be mistaken - but, the crime was still committed!
I would think he's too short and Fat for you!

I just put up some comments about our society and it's priorities and how an innocent man may go to Jail for 20 years because of he's not as attractive and a sacrificial lamb is needed.
