And a favorable judge.

And in NC he gets to pick which judge he puts this in front of. Judges who rule against the DA find themselves not getting any felony cases.
;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;

And we learned previously that the DA sets the Docket and controls how long before a case comes to court too.

This is ridiculous.

FYI (interesting facts)

http://64.233.161.104/search?q=cache:Z6rN3UjpyxAJ:www.law.duke.edu/news/inthenews1999.html+%22durham+nc%22+%22traffic+court%22+scandal&hl=en&gl=us&ct=clnk&cd=1

10.19.99
The News & Observer (N.C.) 2 Durham driving cases get unusual treatment. ... Nezra Clark, with a record of 14 moving violations and a suspended license, took a chance in April 1998 when he got behind the wheel of a car. He lost. Clark was arrested for a 15th traffic violation and faced the possibility of losing his license for a year and spending 45 days in jail. Instead, Clark, 26, paid a $500 fine and walked out of the courthouse Sept. 2, 1999, with his driver's license in force. The difference between his case and thousands of others in Durham's traffic court: Clark was represented by H. Woody Vann, a lifelong friend and the campaign treasurer for Durham District Attorney Jim Hardin Jr., who personally signed off on Clark's plea agreement. ... Thomas Metzloff, a senior associate dean at Duke Law School, said when asked to review the circumstances that it was inappropriate for a lawyer to claim special privilege the way doctors do, because there is a critical difference: The legal system is a public trust administered by court officials, not a private business. "It's insulting to the public," Metzloff said. "If anything, we attorneys are not above the law -- we are a part of the legal system, and that kind of accommodation is antithetical to the rule of law." ...

02.23.99
The News & Observer (N.C.) In Durham County traffic court, citizens who represent themselves aren't offered the same breaks as those who hire lawyers. That means that under a policy set by Durham District Attorney Jim Hardin, people with the same charges and same records can get lighter penalties just for spending $200 to higher an attorney... Tom Metzloff, senior associate dean at Duke's law school and an expert in legal ethics, said the courts shouldn't favor people with lawyers. ...

Well I feel bad if the guy is so feeble minded that he can easily be recruited into such behavior that he would not have done by without being feeble minded. But doesn't that sound to you like just the type of person WHO NEEDS TO BE LOCKED AWAY ESSENTIALLY FOR EVER.

Now whether he needs to be in a prison or where ever, he sounds like a danger to society and needs to be locked up.

Very Interesting! Seem like Woody has a speciality. A certain segment knows whom to call when you need a favorable deal negotiated.

Is this making anyone else sick?

I will be very interested in who the judge is on this case. The power of the DA in Durham is more than we could imagine. For nonlegal minds, it is scary.

Nifong is trying this case and more than likely he will have handpicked the judge. As you have pointed out, he will pick someone "friendly" with his office.

I am slowly coming to the realization that Nifong gets to play by the rules he makes...in Durham he has done nothing wrong. In Durham it is the way things are done.

And Woody V. and M. Nifong are buddies from Traffic court.

Judge said guilty in a make-believe trial
Slapped the sherriff on the back with a smile
And said "Supper's waitin' at home, and I gotta get to it."

That's the night that the lights went out in __________
That's the night that they hung an innocent man
Don't trust your soul with a backward Southern lawyer
Cuz the judge in town has got blood stains on his hands

If Nifong is picking the Judge is going to be an older Black Judge.

The media will never bring themselves to criticize him.

Do you remember Betty Currie? The Media ran out immediately and said this HAS to be false. There is no way that Pure Betty Currie would have anything to do with such a thing. This alone makes it unbeliveable.

Tim Russert said on was beyond belief that Currie would have participated or even known of such a relationship and not resigned!

All this faith and belief all because of her Race and gender. Turned out Mrs. Currie did ask Monica Lewinsky for the incriminating items back and had them destroyed or disposed of in the middle of a Federal investigation. She was also a go-between with deal maker Vernon Jordan.

So, an older Black Judge would be totally off-base when it comes to criticism, in my opinion. Name the first MSM reporter that would utter that maybe the Judge is biased due to his race?

Not going to happen.

I agree ... looks like he's easily led ...

Morris also pleaded guilty to burglary, attempted robbery and possession of a stolen car.

Bottom line: A deal was made with Morris for his cooperation. It seems to be the norm in Durham. Look at Lil' Kim's bond reduction, the pressure put on the cab driver, and LAX players reinstatements of misdemeanor charges. Cooperate with the DA's office and they'll go easy on you. Makes one wonder what deal was made with the AV on her previous offenses.

What did AV give up to have her felonies reduced to misdemeanors, it is an interesting question maggie.

Favors or info?

After reading about the Seagroves case, I am having a very hard time with those that are saying "Let this go to trial so justice can be served".

There is no case. No evidence.

How is it that a district attorney can ruin someone's life - drive them to finacial ruin, slander them and cause them untold anguish and pain... for POLITICAL REASONS?

Bringing it to trial - and letting the boys be found innocent - is NOT justice!

That amounts to judge-shopping! How is Nifong able to do that? They must have some bizarre procedures down there.

The AV called Woody around the time of lineup. Wonder what "overwhelmed" her?

Justice: Off Message

by Susannah Meadows and Evan Thomas
Newsweek

April 17, 2006 issue

EXCERPT

Two weeks ago she called her former lawyer, Woody Vann, for advice. "She was calm but wanting to get some help. She was feeling overwhelmed," Vann told NEWSWEEK. Vann says he told her not to talk to reporters.

That right there is unbelievable and tells us something is amiss.

A Victim - an alleged victim and the lead state's witness are contacting DEFENSE lawyers in the days following the Party.

Is this consistent with the actions of a Rape-victim and sole witness to the event? Or was something else up?/

Rape victims don't contact Defense lawyers. States witnesses don't start shopping for Defense lawyers.

Early on, I had the theory that Nifong & Co. had co-ordinated with the Rape Nazis and the Black Panther crowd to gin up the media into lynch mode.

My thinking now is that Nifong & Co. may have tried to keep it all low key, get a guilty plea and go on with their operation of the Courthouse Crowd. But the thing blew up, they lost control and now it's about to bury Nifong along with all the Courhouse Crowd. All Nifong's bluster early on may have been an attempt to scare the defense back into a defensive position instead of offense...

I can't remember for sure, but I don't think those particular lawyers had been engaged by the defense prior to Crystal and Kim talking to them.

I don't think Woody Vann is a defense lawyer and I'm pretty sure I remember that Kim contacted Cheshire before all this blew up in public.

I'll be I'm misunderstanding your remark.
