First of all, could Smith just get the records from the phone companies without a warrant, and if not, did a judge sign off on this?

As far as I can tell, this is not actual content of phone calls, but the meta data that is collected such as phone numbers call, duration of the call, and the location of the calls.

While everyone seems to be outraged at this, we probably need to be more outraged that this is probably legal, and probably happened a lot more than we even know.

I am sure your post will be very persuasive to those who were spied on...lol.

It would also be totally legal to send every FBI agent, supervisor and director involved to Antarctica as their new permanent station.
