The Homan Set-Up

Tom Homan was investigated for accepting $50,000 from undercover FBI agents. Trump's DOJ shut it down. In the summer of 2024 – as the Presidential election was nearing – the FBI, along with the DOJ’s Public Integrity section and the US Attorney’s office for the Western District of Texas, launched a federal investigation into Tom Homan “based on evidence of payment from FBI undercover agents in exchange for facilitating future contracts relating to border enforcement.”

It is alleged that on September 20, 2024, hidden cameras captured Homan accepting $50,000 in cash from undercover FBI agents posing as business executives to help influence contracts once in the Trump Administration.

The FBI and DOJ waited until after the election to see whether Homan would make good on his alleged promises - an indication that they couldn’t prove their case before the election. At the time of the alleged transaction, Homan was the president and owner of a border security consulting business that was in the business of assisting companies secure government contracts. (An important fact we’ll get to in a moment.)

The New York Times has provided additional context: the $50,000 was inside a Cava bag and the investigation had not specifically targeted Homan (at least initially). Rather, Homan’s name was dropped by a target of another FBI investigation, who “suggested in 2023 that a $1 million payment to Mr. Homan could lead to lucrative federal contracts.” By all appearances, the Feds had someone under the gun and they pointed the finger to Homan out of desperation.

The New York Times continues:

After Mr. Trump took office this year, Justice Department officials shut down the case because of doubts about whether prosecutors could prove to a jury that Mr. Homan had agreed to do any specific acts in exchange for the money, and because he had not held an official government position at the time of the meeting with undercover agents, the people added.

One person familiar with the case said the evidence gathered had not met all the necessary elements of relevant federal crimes, while another contended that the case was effectively ended prematurely, before such additional evidence could be gathered.

The initial reporting on the Homan allegations came from Carol Leonnig and Ken Dilanian at MSNBC, some of the most dishonest and partisan reporters in the media. Dilanian, for example, was one of the leading supporters of the FISA warrants against Carter Page, defended the FISA process and the veracity of the Steele Dossier, and echoed many of the bogus Trump/Russia claims put out by Representative Adam Schiff. Based on these sources, it’s logical to conclude the information on the Homan investigation came from Democrat sources within the DOJ or FBI. There’s an obvious agenda behind this story, one that certainly involved the omission of key facts and the slanting of the story to discredit Homan and the Trump Administration.

White House press secretary Karoline Leavitt has issued a denial: “Mr. Homan never took the 50,000 dollars.”

In an interview with Laura Ingraham on Fox News, Homan responded: “I did nothing criminal, I did nothing illegal.” It wasn’t an outright denial of accepting the $50,000.

For the Democrats, this just isn’t about Homan - it’s about a broader attack against Bondi and Kash Patel, it’s the beginnings of Democrat allegations of a cover-up reaching the highest DOJ and FBI officials.

“Legal experts” and (likely) Biden Administration holdovers within the FBI and DOJ cited by MSNBC believed there was a “strong criminal case against Homan for conspiracy to commit bribery.” Overall, the Biden Administration considered charges for “conspiracy, bribery and two kinds of fraud.”

Bribery or conspiracy to commit bribery sounds terrible, but the limited facts as we understand them don’t suggest any type of criminal activity by Homan. For background, to convict for “bribery and conspiracy to commit bribery, the government must prove that he knowingly accepted or agreed to accept things of value in exchange for performing official acts.”¹

Important to the Homan fact pattern is that Homan was not a government official at the time the transaction took place. Instead, he was a former government official and businessman who offered services to assist others in winning federal contracts. If that were a crime, half of DC would be in prison. (Washington has no desire to criminalize that gravy train.) This is true even when you get offered $50,000 in a brown paper bag by a federal informant. Thus, the Biden DOJ’s decision to monitor Homan’s after the 2024 election.

And about the money - assuming Homan or his associate accepted the money, where did it go? As Shipwreck observed, the status of the $50,000 is a key fact that is “certainly in the case file.” Was it returned after Homan assumed his role within the Administration? Or was it used as a retainer prior to Homan’s current role, while he was still a private citizen? The status of the cash is a curious omission from the MSNBC reporting - it looks like the reporters didn’t even ask their sources about it.

But from everything we know, it looks like Homan (and the federal authorities who ended the investigation) did nothing wrong. It was a case so weak that even the Biden Administration didn’t pursue charges. Even when Kamala was struggling in the polls and needed a bump.

It's unclear whether Homan took the $50K, but even if he did, it wasn't a crime in itself. He wasn't in the government then. So far, nobody has identified anything he supposedly did in exchange for the cash after he became a government official. Even the MSNBC liars haven't come up with anything.

I would have taken 10k for the FBI wasting my valuable time, handed the remaining 40k to the AG in the presence of Trump along with the names of the informants.
If Blonde can’t even get these people arrested, she is done in my book.

They successfully charged and convicted and massively fined Trump for something that wasn’t t illegal. And remember Scooter Libby? That no one cares and that it wasn’t even illegal does not matter. Today in America if you get it before the right judge you’re gold.

When guys show up with a large amount of cash in a bag, they have either mistaken you for a drug dealer or it’s an FBI frame job. I don’t think Homan ever had anything related to drugs, and he’s smart enough to see that these agents were trying to set him up for something in the future. Problem is that he couldn’t go to Merrick Garland about the issue since Garland probably approved the set up. He couldn’t say anything until Bondi took over.
