“And when, in his legal defense, claims that he cannot be charged because he has a preemptive pardon, the government can finally test the legality of the autopen in which all of those documents should not be honored.”
And when Fauci pleads the 5th, then what?
“And when Fauci pleads the 5th, then what?”
Every citizen has the right to plead the 5th (i.e. not give testimony against himself). If Fauci pleads the 5th, and the government has evidence beyond a reasonable doubt Fauci has committed a federal crime, the DOJ will have the option of indicting him for the crime and taking him to trial in federal court.
In addition, if there is evidence Fauci committee a state crime while in the state, the attorney general of the state can indict him and take him to trial in a state court. A presidential pardon offers no protection from indictment and conviction for a state crime.
