Judge Finds No Probable Cause to Search 17-Year-Old Carrying Pistol

On February 5, 2025, an officer responded to a “suspicious person with a weapon” call near a Jack-in-the-Box located on the 5900 block of Gulf Freeway. The video does not say what department the officer was with. The address is in downtown Houston, so the officer is probably from the Houston Police Department. The officer noticed a young man and started questioning him. The young man stated he had been inside the Jack-in-the-Box watching his brothers sell “waters” outside. A man, with a knife in hand, had rushed at his brothers. The young man said he had pulled out a pistol, then moved between his brothers and the man and told his brothers to run.
The officer searched the young man and found a loaded Glock 19. The young man said he had purchased the pistol from a friend for $150. The young man told the officer he was 17 years old. The officer arrested the 17-year-old for criminal possession of a handgun.
This is the information brought to the court in the initial hearing before Judge David Fleisher, an elected Harris County Criminal Court Judge. Houston, Texas, occupies much of Harris County. Judge Fleisher has gained a reputation across the nation for including a hearing on probable cause with the initial court appearance.
Judge Fleisher’s response is interesting. The judge says, “He [the young man] is going to the defense of others.”
At this point, a lawyer in the back of the courtroom stands up and rushes to defend the young man. Judge Fleisher and the lawyer tend to talk over each other, but the lawyer lays out several documents. The documents are a memo from the Texas Department of Public Safety (DPS), saying possession under the age of 21 is not a crime, the United States Court of Appeals

You’ve watched too many movies and TV shows where every gun is supposed to be registered. This typically applies only to certain blue states. I really don’t think Texas requires gun registration. Besides, it goes completely against the 2A.

Fleisher is on YouTube and seems like a fair judge. Young guy with black glasses and wears plaid or colorful suit coats a lot. He does appear to try to follow the law while holding people accountable.

I bought my gun at a gun show in San Antonio. They needed to see my license before they sold me the weapon. I had to wait (it was only 10 minutes) to check on me.
All I am asking is whether the kid had a license to carry.

I havent even shot a Glock and thot I was ragging on them just because of general principle.
Got an almost new Browning BDA .380 auto at the beginning of the year. He wanted just a bit more than that.😂😎 Its the spittin image of Browning P-35 Hi-Power only shrunk down a caliber. Its closer than a cousin. More like a little brother.

Also long discussed for years, they can be trusted at 17 to carry a gun and go die defending their country but they cannot be trusted to carry a gun defend their own person or family.

That’s the standard-issue sidearm for numerous law enforcement agencies, including the FBI, U.S. Secret Service, and various special operations forces like Army Special Forces, Delta Force, and Rangers, as well as many other police departments.
I’ve been happy with the 9mm Glocks I’ve owned.
This thread is the first time I’ve heard anyone trashing them.

Ok. I can accept that.
But NOWHERE here do you find anyone street-peddling outside of an establishment, and I’ve never heard of water being peddled on the street, the presumption being that 1. The restaurant gave them permission to do so, and 2. They had the proper permits. That latitude, I get the water thing. You’d think there would be more street peddlers of umbrellas here, but they’re all stoned sucking & the welfare teat.
For all the merits of this article, “waters” is the one thing that jumped out. Just odd to me.
Speaking of odd: This year there has been explosion of the number of curbside peddlers of fruits - primarily oranges - and with some hawking tamales from coolers. Yes, you may properly presume the origin of said peddlers. It aggravates me because a child can’t sell Kool-Aid without jumping through all kinds of hoops and the Health Dept. just gives a blind eye to these curbside stands (one of which is on a corner outside of a grade school).
In other news, I was greatly impressed when my companion was approached in a parking lot by a guy offering to polish his headlights. There’s a glimmer of hope in there somewhere...as well as the brothers selling water rather than the alternatives.

They do have to have a “Driver’s License or ID” to run a background for sales. But Texas like Az and some other states have “Constitutional Carry” which is carry open or concealed with no carry permit/firearm license needed.

I bought the Glock 19 brand new. It had the following issues:
1. It would jam when feeding into the chamber.
2. It would stove pipe during ejection.
3. Many of the ejected casings flew at my head.
4. The trigger had to be pulled a mile before it engaged anything and has a poor reset.
It was sent in for warranty. They did nothing to it.
Someone said to try new magazines. I paid dearly for new magazines and they fixed issues #1 & 2.
It still throws spent casings at my face and the trigger still sucks. A gunsmith said a trigger kit will fix the trigger and a different recoil spring will fix the casing at my face issue. The gunsmith said certain Glocks are notorious for lousy triggers and most people don’t know the difference.
It’s the only gun I ever bought that sucked to high heaven right out of the box. It will never compare to the 1911, my XD40 or P365.

Most guns are made on assembly lines.
A bad one can get through.
As a former LEO armorer, instructor for over 3 decades. I have worked on and maintained.
Many different makes, models of handguns.
Firearms made by the major manufactures for the most part work really well.
Glocks are no exception.

I was in a gun shop the other day where the salesman demonstrated a trigger pull gauge on a $4300.00 9 mil handgun. I asked why so expensive? He said it was all hand made.
The trigger pull was so smooth and crisp it was unbelievable. And the trigger pull weight was only 2 1/2 lbs.
I bought the Lyman trigger gauge. The trigger pull on my handguns was quite consistent except this Glock. The checks ranged from 2 1/2 lbs to 5 pounds. The gun is clean and it’s been this way since new. So yes, I got a bad one.

Send it back or find a Glock armorer. Should be easy to sort out.
