The U.S. Court of Appeals for the Sixth Circuit has suggested that Michigan would use a two part test to determine whether or not a violation of the right of publicity has occurred, in which the plaintiff must demonstrate pecuniary interest in her identity” or “That her identity has been commercially exploited by a defendant” Obviously the second reason should be a problem for the state. To enter a candidate’s name on a ballot after he has withdrawn, is a violation of his rights based upon the first amendment.

It may not be settled as it's likely to be appealed (or already has) but it's encouraging the courts didn't let SecState Nessel get away with it. Appeal Court judges likely saw what Nessel has tried to do:

keep RFK Jr. OFF THE BALLOT when it favored Ds,
and then reverse course to keep his name ON THE BALLOT when it favored Trump.
