According to the New York Bar Association, to be appointed Judge in New York, one has to be a U.S. Citizen, a Naturalized Citizen, or a Permanent Resident Alien.

There could be a difference when one is simply advocating for their political beliefs (Thomas’s wife) and one is supposedly realizing serious financial gains off of their family connections (Merchan’s daughter).

It is doubtful the first is political activity. Judge Thomas’ wife says it was a response to neighbor harassing her not political activity. Additionally no monetary gain or influence.
Merchan family, money, influence based on trial and on outcome...big deal. The judge has made small donation to Biden and other democrats through ACT Blue. That is against ethical rules and speaks to bias.
