The FDA has long regulated drugs.

Drugs are commercial products subject to the Article I Section 8 commerce clause.

Of course, a legal right alone does not justify a legal action, which should be based on the ‘necessary and proper” clause.

Making commerce regular (consistent) between the States has nothing to do with the power to ban or heavily restrict anything. Why would alcohol require a Constitutional amendment to ban, but other drugs they can do whatever willy-nilly?
