Let's look at this Penal Law 175.10
It says: A person is guilty of falsifying business records in the first degree when, with intent to defraud
Who was Trump intending to defraud? The State of New York? How was this NDA an intent to defraud the state? Let's continue....
It says: "....that includes an intent to commit another crime"
What crime did Trump intend to commit other than to protect his wife and family from scandal? Let's continue...
It says: "... to aid and conceal the commission thereof..."
The only concealement I can see is to conceal his affair with Stormy Daniels, but that isn't illegal. Let's continue....
It says: "...makes or causes a false entry in the business records of an enterprise"
So here's the MAIN POINT -- Is payment for a non-disclosure agreement part of a LEGAL FEE or not? If not, why not?
