I think I heard Levin say this conviction has to go to SCOTUS for appeal ASAP, or the rule of law in the USA is dead.

This is my understanding of Levin's comments :

• The NY DA elevated the already dubious business record misstatement misdemeanor charges into felonies based on the claim that the misstatements were intentionally made to hide proof of a crime.
• The crime that NY alleges Trump committed was misappropriating Federal campaign funds.

So (again as I understand it) NY convicted Trump with 30+ State felonies for alleging he violated Federal election laws, thus overstepping the Constitutional jurisdiction of the State, and this requires immediate intervention and reversal by SCOTUS to preserve Federalism.

If these payments to Cohen fall under FEC guidelines would this not be a federal case?

The most I see is campaign violation and maybe IRS violation.

Or maybe it was a New York State tax violation.

Or maybe it was illegal campaign advertising.

Or maybe...

That was Merchan's instruction to the jury.
