Ammunition Depot and Others Declare Legal Victory for California Gun-Owners

BOCA RATON, Fla., Jan. 31, 2024 /PRNewswire/ -- Marking a major victory for California gun owners and advocates of Second Amendment rights, a federal court in the District of Southern California today ruled to strike down the state's 2019 ammunition law requiring in-person background checks for every individual purchase of standard ammunition.

The decision comes after a knockout lawsuit—uniting the national online discount ammo retailer Ammunition Depot, the California Rifle & Pistol Association (CRPA), and Olympic shooter Kim Rhode, among others—and challenging the new process' excessive restrictions on law-abiding residents. The court firmly sided with challengers in concluding that the state's policies fundamentally violated the constitutional rights of California's nearly 40 million citizens.

It’s nice to see so many judges using COMMON SENSE against the politicians’ INSURRECTIONS against the Second Amendment and the Bill of Rights. If they had tried their sh*t during the time of the Founding Fathers, they’d all be swinging from tall oaks.

As with all the other Judge Benitez rulings, this will likely be appealed and stayed by the 9th.

Meanwhile, online ammo dealers are getting hammered with orders from CA. For those NOT from CA, this decision kills (until the 9th steps in) a law that banned Californians from buying ammo out of state, meaning they had to go to their local gun shop and submit to a background check to purchase ammo. Many online dealers were following this case, and immediately opened to CA customers. Some delivery drivers are going to have sore backs...

When Benitez struck down CA's ban of magazines larger than 10 rounds in 2021, there was a similar flood of purchases (of magazines) until the 9th Circut intervened, stayed, then struck down his ruling. Benitez ruled the ban unconstitutional again in 2023, and that ruling was stayed by the 9th, pending review.

For now. Maybe a week or 2. Pity this didn't happen when I was in AZ a few weeks ago. Of course, the check point I always drive through is only interested in fruit, not ammo.

And before this ruling you would go to jail if you get caught smuggling it into Ca.

The worst one they have on the books is their firearms and ammunition import law. If you move into Ca you have to check all your firearms and ammo into the hands of a FFL licensed firearms dealer to hold for you at a storage cost of course while you apply and wait for permission and a permit from the state to get possession of your own firearms and ammo back.

They don’t ask for it at the port of entry. But if your car is searched for some reason it is considered an illegal “straw purchase” into Ca.

People are doing this now. Unless you’re a known criminal or a complete idiot and put the ammunition in plain sight there’s virtually no way you will be caught. The agriculture inspection stations rarely even check passenger vehicles for fruit, unless you have it in plain sight.

I understand people are doing it, and I’ve never heard of anyone being caught. Last time I returned, the agricultural/CBP checkpoint wasn’t even manned. This silly law, like many others, does little more than create new “criminals”. Of course I, a law abiding citizen, would never do such a thing.

A good friend works at the one on I-40 coming into Ca. This depends on what state you are coming from. If there is an agricultural pest or blight alert for something in another particular state then they will search for sure.

But even more important than agriculture they worry about boats having water pooled in the bottom and not drained that might have fry or eggs from an invasive species.
