I heard Smith sounded weak and unconvincing in his last press conference, which lasted about 2 minutes before he ran off the stage.
Maybe he is being forced into this. (willing, though)
Barnes take on the indictment and legal challenges were terrific. Worth watching.
Robert Barnes is one of the best lawyers in the country IMO. He is also very knowledgeable about the polling data and voter trends....this is a guy who made a fortune going over to the UK and betting on Trump to beat Hillary in 2016.
His always informative show with Richard Baris called What Are the Odds which goes over the polls and political trends airs today on youtube/rumble at 2 pm. Its well worth watching.
I liked it too. Made me realize how far we’ve strayed from the Constitution.
I think the biggest point I took away (and I’m paraphrasing) is that the Constitution basically invests all power in the person of the President. The rest of the Executive branch all operates at the power/discretion/whim of the President.
And thanks to Bill Clinton’s antics, it’s already been legislated that anything the President takes with him after he leaves office becomes his personal property.
I found the argument that a Presidential indictment under the Constitution must only come after Impeachment/Conviction/Removal for the same charges even after leaving office. Nancy sure helped that intepretation by impeaching Trump after he left office.
One thing I’ve wondered after watching the video, and it’s a hypothetical.
Does the current President have the power to classify information that the former President has declassified by declaring such information part of his personal records? I’m guessing that’s sort of silly as declassification has essentially let the cat out of the bag but it would be an interesting legal question.
I listened last night and this was a robust defense. Trump needs to hire lawyers like this.

DJT has some pretty good attorneys. It is pretty likely that they have done it all already.
But who better than Barnes to tear apart Jack Smith's sham indictment in public? This is MORE than just a mere court case. This must be fought in the court of public opinion. Would love to see Barnes in a role as Trump's attorney out there on the media breaking down the case on a regular basis.

Watched this last night as well. Thanks for posting, I had plans to post it today as well. For those too lazy to watch, I was going to make a list of every point he made.
Folks, this is a must watch. Every silly argument we are seeing on twitter and here does not apply.
Ex. Declassification process, only applies to everyone BUT THE PRESIDENT. It exists so that others can share/see info. The president can share anything he wishes, no declassification process for him.
Smith using a DC judge and grand jury, not constitutional.
Smith forcing Trump lawyers to hand over attorney-client notes, not constitutional. And Smith making the lawyers witnesses so they can’t represent Trump, unethical.
No due process on the raid.
Etc etc etc. Barnes covers several items that are unconstitutional. His take - take power away from Presidents and give it to the deep state.

Simply possessing items requested back, refusing to cooperate in their retrieval and/or sharing with un-authorized individuals are the charges.
All nulled by the fact that anything President has in his by definition, and he can do with it as he pleases.

BOTTOM LINE is Trump's docs fall under the PRESIDENTIAL RECORDS ACT, not the ESPIONAGE ACT!

The ESPIONAGE ACT DOES APPLY to a SENATOR JOE BIDEN OR VICE PRESIDENT JOE BIDEN WHO STEALS CLASSIFIED DOCUMENTS FOR SALE TO FOREIGN ENEMIES OR FOR HIS SON HUNTER TO SELL TO FOREIGN ENEMIES IN EXCHANGE FOR MILLIONS OF DOLLARS PLACED INTO SECRET LLC BANK ACCOUNTS.

Which is a dagger aimed right at the heart of the Republic. Wray is not elected. Garland is not elected. The attorneys in the DOJ are not elected. Nor are the military.
To presume a clerk in the National Archives has the ability to say the President can/cannot declassify something per his perogative is ludicrous.
Barnes made a good point about Congress passing a law that makes it illegal for the President to execute his Article II powers--its nuts.
