I get that the Marine was trying to do what he thought was the right thing. But the homeless guy had not touched anyone yet. Homeless guy probably was saying things that could be interpreted as threatening, but that’s not enough.
A NYC district attorney and then a NYC jury will judge this Marine. He is in serious trouble.
