Absolutely right. A little bit of a tangent: It’s ridiculous to have a separate crime of “attempted murder” on the books. If someone consciously plans to murder someone, and then tries to carry out that murder, they should not get a lesser charge just because they were unsuccessful in killing the person. They should receive exactly the same punishment as for a successful murder.
