People in power routinely violate the rules because they think they can. That can be challenged in the courts, but that requires great expense and judges who want to reign in arrogant executive branch officials. People in and out of power do whatever they get away with. This was termed the “state of nature” and is seen in smash and grab LA robberies just as in DC.

If one group plays by rules and its opponents do not, we call that oppression or tyranny. If all parties play by the same rules, we call that “civilization.”

The left has chosen its course. If the right wants to obey until they’re given permission, well then. A certain degree of forbearance is prudent of course, but try not to wait until you’re actually on the train car.
