Ex post facto laws are unconstitutional, so if it is not illegal for them to protest at the time they are protesting, then it can’t be illegal 2 years later, no matter what laws Congress passes in the future.
There may not be a Constitution in the future. At least, not the one the US has now.
What is illegal and what is prosecuted are two different things.
