Why were those three jurists on the jury anyway? Can the lawyers cull them out during jury selection by asking if each one would support life in prison or the death penalty?
The only time I was in a jury pool for a murder trial the prosecuting attorney asked each of us if the perp was convicted would we support the death penalty or life in prison. If you said ‘no’ you were out. Conversely the defense attorney asked us if we would support a minimum sentence and if we said ‘no’, also out.
Maybe those questions are not legal anymore ...
If one keeps their mouth shut during jury selection.
We need more jury nullification.
It is a long held tradition with juries.
That has been suppressed and under used.
Not that it was rightly used in this case.
But there are plenty of laws that it needs to be used on.
