“Where are the lawsuits?

The remedy for tyranny by the executive branch in the Constitution is impeachment, not lawsuits. The founders never intended the Judiciary to be the ultimate decider of issues, much less have the ability to make and change law. There are supposed to be three co-equal branches in the federal government with each have specifically delineated powers versus the other.

Unfortunately over two hundred years Congress has abdicated its governing power to the Executive and Judicial branches to the point it is the weakest branch, not co-equal. It gave up the power of declaring war to the Executive. It has given significant rule making power to the unelected Executive bureaucracy. It refuses to impeach wayward judges who blatantly ignore the Constitution. It allows the Judiciary to cancel laws it pass and the Executive to ignore them or enforce them selectively. Congress has morphed over time into a corrupt and weak institution that doles out money and special favors to constituencies and redistributes wealth.

I no longer trust the judicial system to administer anything approaching equal justice under law. Most federal judges and Supreme Court members went to elitist law schools which taught the “living Constitution” that is essentially putty in the hand of judges. They are members of an exclusive “club” and they are more concerned with the applause of their fellow travelers than the letter of the law.

So we have no recourse.

Because impeachment is not an option.

You could say the same about the Roman Senate. In this case, history repeats itself. The American Presidency is morphing itself into Imperial Presidency. So how do we stop that?
