The Constitution has no language to impeach a private citizen, thus Gaetz can legally serve as Trump's counsel, and in fact should press the matter to SCOTUS just to pull Queeg Roberts into the fray.

As a sitting member of the House that is prosecuting the former Pres., I don't think so because Nancy and McCarthy would go bonkers and probably call to censure Gaetz, which is why he would resign his seat before serving as a member of Trump's legal defense team.
