True, but absent of any other corroboration, it is weighted as "hearsay".
Corroboration would include other witness attendance, sworn testimony, written instructions, or even video surveillance.

If so, I believe that it would have been a violation of State law.
If the Democratic representative was not present, the witness could sue in civil court for damage to reputation.
