I’m wondering if this wasn’t a special ops mission of some sort, which is now it’s own arm of the military but outside the joint chiefs reach.

If the server was being housed in a US consulate (think CIA cover), it is considered US soil. Consulate is State Dept property. With proper US authority (POTUS?) it would be possible and legal.
