Im confused...its good that it cant be enforced anywhere while in lower courts, bad that Roberts wouldnt let it jump to higher court.
Good, but Roberts bad and ugly?
Not good.
Trump and DHS cannot enforce the new policy anywhere until the lower courts settle the issue.
So, Roberts is allowing one Federal judge to decide Presidential policy on immigration, where the Executive is given that administrative power under the Constitution.
Trump should do what Andy Jackson did with Justice Marshall.
Say, “Justice Roberts has made his ruling, now let his enforce it.”
We cannot have the Judiciary constantly at every turn constraining the Executive from protecting the American people.
It is a separation of powers issue, and should be framed that way.
Otherwise, we might as well hand over the Oval Office to the Ninth Circuit.
