Jeb Bush asks new Republican administration to flex its muscles with a constitutional convention

In an op-ed for the Wall Street Journal, former Florida Governor Jeb Bush makes the case that the incoming Republican administration should set the agenda by calling for a constitutional convention to establish term limits, a balanced budget amendment and restrictions on the Commerce Clause.

Bush asserts that the 2016 election was largely a protest vote over the growth and power of the central government and that Republicans have a rare chance to shift some of that power back to the states.

Bush wrote:

But here’s something we shouldn’t forget: This election was more about voting against something than voting for something. Americans voted against the “establishment,” against the country’s changing culture, against a dysfunctional Washington, against the privileged,

If his last name wasn’t Bush, he’d be working in a cubicle farm and living paycheck to paycheck. He would be busy trying to locate his stolen red stapler.

Yeah ... the Republicans ... the same worthless bunch that tries to preserve FDR’s legacy even while they occasionally try to slow its growth.

A horse that occasionally walks in the right direction, that is known to stumble, is a better critter than one that only runs the wrong way but it still isn’t a horse I’m willing to bet the farm on.

Frankly, that there is basically nothing left of the old far left that’s considered “extreme” anymore is not only a function of the fact that the DNC is a hive of lunacy. The Republicans have the same progressive disease too, even though less virulent.

Just their lamentable habit of going along to get along should bar them from that level of trust.

The Republicans are good for trying to suck less and that’s about it.

At least two of these three goals are in the “First 100 Days” speech of DJT, President-Elect. Jeb ain’t having any original ideas lately, and shouldn’t get credit for those who do have original ideas.

Republicans hold 34-35 legislatures...both houses. The Progressive agenda holds no chance that 13 of them would not oppose anything they come up with. Any fear that Progressives would have a nit of influence over what is proposed (2/3 of states) or what is ratified is simple ignorance.

This.

Be smart. It does not matter who issues the call.

Forget the wisdom of a Convention of the States. Every comment on this thread needs to say that Jeb is a Big Poopy Head.

Thank you for referencing that article ColdOne. Please note that the following critique is directed at the article and not at you.

”… by calling for a constitutional convention to establish term limits, a balanced budget amendment and restrictions on the Commerce Clause."v

Noting that I am no fan of Jeb Bush, please consider the following.

I have a problem with amending the Constitution as a solution to stopping criminal activity in any of the three branches of the federal government. I say leave the Constitution alone and impeach the crooks out of the system instead.

On the other hand, the states should consider amending the Constitution to give themselves the power to impeach and remove crooks from federal office since corrupt Congress has shown that it cannot be trusted to do so.

In fact, that’s one of the reasons why I gladly voted for, “You’re Fired!,” Trump.

Regarding term limits, the problem is that corrupt lawmakers are wrongly letting POTUS and non-elected bureaucrats get away with stealing and exercising state powers to harass the sovereign states. So regardless if the constitutional terms limits of such lawmakers have been reached and the lawmakers are out of office, the non-elected bureaucrats that they hired while in office are still in the system doing their dirty work.

Patriot need to work with Trump to make lawmakers take full responsibility for all federal legislative / regulatory actions as mandated by the Constitution.

Regarding balanced budget, previous generations of state sovereignty-respecting justices had clarified that Congress is prohibited from appropriating taxes in the name of state power issues, essentially any issue that Congress cannot justify under its constitutional Article I, Section 8-limited powers.

“Congress is not empowered to tax for those purposes which are within the exclusive province of the States.” —Justice John Marshall, Gibbons v. Ogden, 1824.

And a Section 8-compliant budget would probably cost taxpayers much less than a non-Section 8-compliant balanced budget.

Regarding restrictions on the Commerce Clause (1.8.3), simply get rid of the perversion of that clause by FDR’s state sovereignty-ignoring activist justices.

In fact, FDR’s justices wrongly ignored that a previous generation of state sovereignty-respecting justices had clarified that the states have never delegated to the corrupt feds, expressly via the Constitution, the specific power to regulate INTRAstate commerce.

”State inspection laws, health laws, and laws for regulating the internal commerce of a State, and those which respect turnpike roads, ferries, &c. are not within the power granted to Congress [emphases added].” —Gibbons v. Ogden, 1824.

Jeb does not want this. Jeb knows that his enemies, the conservatives want this. He also thinks it is not polically possible at this time. This is sour grapes, and he want to see Trump step on his own d!ck and fail.

“An amendment for balanced budgets will end in a requirement for ever increasing taxes. Once it is required that spending shall equal income, how quickly do you think it will be before Congress claims the Constitution handcuffs them in raising taxes to cover ever-higher spending?”

I hear you - make it a spending limit then. We do need something stronger to get federal spending under control.
