Her defense of partial-birth abortion is one of the most shameful dissents ever written by a Supreme Court Justice since Plessy vs. Ferguson. She came to the court from the ACLU which regards the legal system as an instrument for advancing its political desires disguised as regard for the Constitution, a sham which falls away as soon as the Constitution conflicts with deeper Marxist values.
Her comments tell us that there is no jurisprudence being done by at least four members of the Supreme Court, they always work backwards from a desired result to find attenuated justification in the Constitution, not infrequently abandoning that search to embark into the shadowy realms of the penumbras and the gaseous world of emanations.
Even as the Supreme Court trades on its prestige and reputation (not unlike that of the FBI) for nonpartisan impartiality, Justice Goldberg tells those of us who will listen that we are fools to believe.
