There's a ton of time until the election to sort it out. OTOH, if there had been an indictment, Clinton's lawyers would probably have just enough to time to get one of their corrupt judges to throw out the case and it would be on appeal at election time. The indictment would have been a clearer message if Comney wanted to send a message but I'm not sure he has 100% free will at this point.
