I think Bryan Pagliano has backtracked and said he will not testify.

You're confusing two things, but it's because the media (deliberately) muddled the reporting. Pagliano has received immunity to testify in front of the FBI, and his has been so testifying. Pagliano also has been invited to answer questions in front of Congress, which ha has declined to do because he has not received immunity to testify in front of Congress.
