TRUMP UNIVERSITY LAWSUIT UPDATES
On November 18, 2015, the Court issued an Order primarily denying Donald Trump and Trump Universityâs Motion for Summary Judgment. The Court dismissed plaintiffsâ claims for injunctive relief, but otherwise denied Defendantsâ motion for summary judgment, holding that the case may proceed to trial on Plaintiffsâ claims for:
(1) Violation of Californiaâs Unfair Competition Law (âUCLâ),
(2) Californiaâs False Advertising Law (âFALâ),
(3) Californiaâs Consumers Legal Remedies Act (âCLRAâ),
(4) Financial elder abuse under California law, Cal. Welf. & Inst. Code Section 15600
(5) Violation of New Yorkâs consumer protection statute, Section 349 of NYâs General Bus. Law
(6) Violation of Floridaâs consumer protection statute and elder abuse law, Florida Deceptive and Unfair Trade Practices Act (âFDUTPAâ) and Misleading Advertising Law (âMALâ)
So what!
In business you win some and you will definitely lose some. As long as you win more than you lose is all that matters.
If this is being tried in California, Trump’s net work is going to take a significant hit. California has some of the toughest consumer protection laws in the country.
