Also, it would be easier for Trump, if he wins the nomination, to ask for and get either a declarative judgment or a Congressional resolution, or both, completely erasing the Cruz birther issue.

Trump has in as many words told you that this whole birther flap was to clear the deck for a Trump/Cruz ticket and disarm the democrats of what would be their best shot at derailing the ticket. That's strategic thinking at it's finest, as well as grand political theater.
Trump/Cruz 2016 is pretty much a done deal.
