The Bandidos are the largest outlaw biker gang in Texas. They run a group called the “Conferation of Clubs and Independents”. That is kind of a national group, but the state chapters are run independantly. It began as a legitimate association of motorcycle clubs with noble goals, but most of the state COC’s, if not all of them, have been taken over by the larger outlaw clubs, who use them as front organizations.
The Bandidos, holding the presidency of the COCI, would demand that other clubs join and pay dues to them, as a kind of legal cover for extortion payments. Those clubs that did not join could face violent retribution from the Bandidos for not paying the so called “road tax”. Some exceptions are usually made for some kinds of clubs though, like non-harley riders, or Christian clubs, etc. The Cossacks were a smaller outlaw club, who did join the COC, but then got upset because they found out the Bandidos support clubs (kind of like junior clubs that are recruiting tools) were not being made to pay COC dues.
So, the Cossacks left the COC and started wearing the “Texas” rocker on their cuts anyway, as a sign of defiance to the Bandidos (only Bandidos and their support clubs, or those they give permission to, can wear that rocker because it is a territorial claim). In outlaw circles, this act was essentially a declaration of war. What followed were a number of violent incidents between the two gangs, including at least one murder prior to the events at Waco.
The Waco incident happened when the Bandidos decided to move the District 1 COCI meeting to Waco, the Bandidos’ home turf, and called on their members and support club members from outside the district to attend. It was, at the very least, intended to be a “show of force” to the Cossacks to intimidate them. It doesn’t appear the Cossacks were invited, but there are some reports that they may have been invited on premises of a “sit down”. Nobody really knows, at this point, whether that was true, or if true, whether it was a setup on the part of the Bandidos.
Whatever the reason, the Cossacks showed up to the COCI meeting, ahead of the Bandidos, and took over the patio section that was reserved by Bandidos members. Then, when the Bandidos showed up, all hell broke loose between the two gangs pretty quickly.

No, there have been criminal affidavits made against them to support their arrest, though they have not been formally indicted yet. Texas law allows for that type of detention before the indictment, but probable cause must be shown before a judge, and that has happened (not sure if all those hearings are over yet but so far, in all that were conducted, the judge concluded there was probable cause). Most of them have already been released on bail, except for a few who did not pay their bail.

The law in question is state Penal Code Title 2, Chapter 9, Section 42, which says using deadly force to protect ones property is justified in limited circumstances, including when the person “reasonably believes” such force is necessary to prevent imminent “theft during the nighttime” or “criminal mischief during the nighttime.”
These dudes are unreal. Desperation reigns.

What you will not (or perhaps can not) fathom is there is a difference between calling someone a Nazi or a Communist and pointing out how history can show how certain actions impelled by certain mindsets lead to certain outcomes.
I assume no one here wants the outcomes of Germany, Russia and China.
Alarm bells should have been sounding and should have been amplified by the press over mass arrests, flimsy probable cause, excessive bail, (resulting in punishing the presumed innocent). Pointing this out does not equate to calling someone a Nazi.
We all want to know what really happened on 5/17. But, the aftermath is what is equally and perhaps more important, even vital.
I am related to bikers, I grew up around bikers, I am very close friends or siblings with many and have spent well over 50 years on the periphery of normal independent bikers as well as had semi family-ties with truly seriously bad-ass criminal dudes, gang bikers who went to prison for good reason.
I, however, am not a biker. I DO understand that whether we're talking American bikers or any other demographic, violent criminals are very different from outlaws and rebels. I value, respect and love many outlaws and rebels; I abhor criminals who assault, abuse, rob, murder, kidnap, and/or extort innocents.
You'll see that the folks who guy the "heroic cops versus evil bikers" narrative fail entirely to perceive the difference between a violent criminal and a rebel outlaw.
Rebel outlaws CREATED AMERICA.
Violent criminals harm innocents.
And the half-dozen or so boot-licker FReepers here who believe 117 members of "criminal biker gangs" with zero criminal histories conspired to commit murder and mayhem at a busy public restaurant during Sunday brunch in the presence of God only knows how many marked police cars, are worth ignoring about 99 percent of the time -- it makes reading these threads much more informative and enlightening.
