Yes I've heard it quite a bit too. In debating that's called, "begging the question." If killing someone with your car is murder, then what should the penalty be? If we can't all reach a unique and common answer should it then be legal? Of course not.

That makes no sense.
If you can prove that you killed someone with a car intentionally and with forethought, than the penalty like any other murder is death or life imprisonment.
And abortion isn’t legal because we can’t come up with a generally agreed-to punishment.
