That's if it can be determined if he was thinking clearly the whole time. If he was tasered (not yet proven), he might not have been in his right mind the whole time. Again, let's wait for more evidence to come in before making judgment.

You are right, it is a jury question. But if I were the prosecutor, I would point out that he was thinking clearly enough to take eight shots with deliberate aim, and then move the Taser to beside the body in order to stage the scene. Personally, I doubt that a jury is going to give this defendant much credibility, regardless of what he says.
