Police summoned to investigate fictional story about killing a dinosaur, student arrested

SUMMERVILLE, SC — Police were summoned to a high school after a boy wrote a story about using a gun to kill a dinosaur. The boy was searched, suspended from school, and subsequently handcuffed and arrested when he did not handle the interrogation calmly.

Alex Stone, 16, said he was assigned to come up with a fictional story for a creative writing assignment at Summerville High School on August 19, 2014. The brief assignment involved writing a few lines that were supposed to mimic a social media post; a “status update” drafted on paper.

Stone’s submission discussed himself and a fictitious dinosaur that lived next door to him. He wrote that he used a gun to kill the dinosaur.

“I killed my neighbor’s pet dinosaur, and, then, in the next status I said I bought the gun to take care of the business,” Stone said to NBC 12.

The mere mention of using a “gun” to “take care of business” prompted school administrators to phone police to report the suspicious narrative. The Summerville Police Department responded to the absurd call, expending taxpayer resources to investigate a boy’s imagination.

Without probable cause of a crime, police searched Stone’s personal belongings, his backpack, and his locker, presumably looking for a gun or a deceased dinosaur. They found neither.

As Stone was interrogated by police and school administrators, he insisted his writing was only make-believe; a joke. They continued to press him, and police documented his eventual reaction as “irate.” They placed the student in handcuffs and hauled him off to jail on a charge of disorderly conduct.

The entire experience could have been avoided if school staff would have accepted the narrative as the fantasy that it was intended to be, as prescribed by the assignment.

No sh!t, there I was. Up at dinosaur national monument (that’s where thy live you know). I’d been following his trail of knocked down trees for days until I saw him about 2400 meters away, eating a subway train. So I raised my ghost gun, put in a 30 magazine clip and ... At 16 If the police had questioned me about shooting a dinosaur I would have admitted to it and led them to where I had buried the body.

When my uncle was a youngster he was accused by the police of stealing some cash from a local business. The cops repeatedly asked him where the money was and he continued to insist that he didn't take it, so he didn't know. Finally one clever cop said, "OK you didn't take the money but if you had taken the money where would you hide it?"

My uncle thought for a minute and said that he would hide it in the rear upstairs area of an abandoned building that was nearby. The cop went into the building and searched the area for a while. He came back out dirty and covered with cobwebs and said, "there's no money up there!"

To which my uncle answered, "I told you I didn't take it!"

Suggested new state law, the “common sense and responsible adults” law.

That is, adults in positions of authority are expected to use good judgment, and use the powers granted to them in a responsible manner.

For example, school administrators are authorized to exercise discipline and appropriate punishment over their charges, only contacting the police if a serious misdemeanor or felony has been actually, not subjectively committed. And when police are contacted, they in turn are supposed to use good judgment when considering if there is a need to detain or arrest juveniles. Unless an act resulting in actual harm has taken place, school discipline should be regarded as adequate.

In return for this, if a responsible adult uses reasonable judgment, they should be immune to lawsuit arising from that judgment.
