California law requires that either one or the other of the parties in a conservation must announce they are recording the conservation. That is why when you are making a call or receiving a call the party usually announces this conversation is being recorded. If no announcement is made and the call is used in a court or played to the pubic they have committed a crime. Am I wrong?

That certainly is a foolproof way of protecting yourself .

If she was to claim that he gave his OK (which she is) and wo proof it doesn't pass the smell test.

Unless he was to let her off the hook.
