The Justices of the Alabama Supreme Court accepted the Amicus Brief from the Democratic Party of Alabama which includes the whitehouse.gov image of Obama’s Birth Certificate and a copy of the Mississippi Federal Court’s Letter of Verification.
The Alabama Supreme Court, is an appellate court and that means the Court doesn’t rule on evidence. Each Justice will make their own individual determination on what briefs submitted to them they find to be helpful. They may or may not reference any particular brief in their individual written opinions.
We will probably never know whether any of the nine Republican Justices threw the Democrat’s brief in the trash or whether they read every word.
What the Justices may find of interest is that the Democrat’s brief is written to support the legal position of the Republican Secretary of State of Alabama.
