Actually, so far it is circumstantial evidence. But it looks extremely likely.

If a off duty police officer had a concealed weapon and shot him that would be still stupid? If people are trained to use a firearm. (granted not as trained as officers) Still the same lead slamming through the brain stem stops the behavior. What does it matter how the bullet reaches the brainstem.?
Someone on another thread pointed out that those are NYPD officers carrying the protester, not San Diego police officers.
