Totally irrelvant to the charge of disobeying the order of his brigade commander.

They will then either choose to allow discovery, or refuse to hear his arguments, strike them from the record, and jail him for heresy.

Probably the second one.

Laken will then sue in a civil court for lost pension and benefits...

Sue who? Obama? Lakin will lack standing to sue him. Sue the army? He will have been convicted by court martial, he'll have no grounds to sue just because he's been convicted.

I think not.

You never know. OJ Simpson was found not guilty but then ordered to compensate for killing two people.

A few people have been on Death row that have sued the state for wrongful conviction. They were found guilty as well, but were then released and compensated.

A court of law is used to find justice. Until its over, it ain't over. You and I do not know where this will go.

I remember Paula Jones coming out of the closet a few months after Clinton got elected. If I said she would force issues that would end in impeachment, conventional wisdom would declare me insane. But that is what happened.

Suppose Laken finds a sympathetic civil Judge in California who allows discovery? Suppose that Judge then orders Occidental to provide all documentation on Obama, and then they find he applied as a foreign national?

This is why people settle out of court. You never know where a legal matter will end. You and I do not know what Mr. Lakens attorney is planning, and what cards he holds.

The other problem is, Obamas original BC is the DNA of his birth. The nexus of his claim to the presidency and his NBC status. Until that comes out, I believe it is morally wrong to convict or punish any man who questions his citizenship. I am not alone in this and would not be surprised to see a civil or military Judge defend Mr. Laken and demand Obamas documents. Even in this military trial.

Oh yes, I could be wrong .... but every week there are more birthers than there were the week before. A conviction of Mr. Laken may very well create greater demand for documents. We will see.
