Isn’t there an execption in the law for journalists?

If not, they should argue the 1st amendment freedom of the press provisions override the law.

You can make a decent argument that everytime the local news shows film, it violates this law, as I’m sure there is someone in the camera range that didn’t give permission to the local news team.

I’m trying to imagine the number of lawyers that stand to support ACORN at all costs—to protect the major players that begin and end with Hussein and his minions.

If I had tapes of workers in 5 Walmart stores encouraging me to commit crimes as part of their employment and those workers sued me I could not use discovery against Walmart?

Just asking, I don't know.

But in a civil case, the rules of discovery are much easier to get evidence. ACORN, more than likely, would have to turn over evidence...especially because these people were employed by them.

Unless ACORN gets a judge that will fix the case for them...ACORN will be coughing up documents

Acorn might outfox itself having the fired workers sue...discovery may be ruled necessary up to the date of the termination...let us see how it rolls. The young investigative journalists will not lack for financial support from patriots nationwide...ready to write a check myself.

ACORN can be third partied in. At the very least they will be fact witnesses that can be deposed and have records that can be subpoenad.

But there is a fatal flaw in their logic as the prosecutor said:

City state's attorney Patricia Jessamy said on WBAL's Shari Elicker Show that she could not prosecute based on restrictions for evidence obtained illegally.

Now they will have to testify in open court to illegal acts and self incriminate. These are not smart people.
