I also am not a lawyer, but it seems pretty clear to me the law is INTENDED to address fraudulently representing oneself as an MD for medical purposes. Otherwise, someone could theoretically be arrested for dressing up as a surgeon at a costume party!

BTW, it is also against law to impersonate a military officer, police officer, etc. Yet, no one is arrested for merely claiming to be such.

This varies by State. For example:

Ga. Code 16-10-23 “A person who falsely holds himself out as a peace officer or other public officer or employee with intent to mislead another into believing that he is actually such officer commits the offense of impersonating an officer and, upon conviction thereof, shall be punished by a fine of not more than $1,000.00 or by imprisonment for not less than one nor more than five years, or both.”

“DOES NOT REQUIRE VICTIM BE MISLED. —Defendant’s contention that, because the victims never believed that defendant was a police officer, the evidence was insufficient to support a conviction of impersonating a police officer was without merit because the crime does not require that the victims actually be misled.”

- As you openly admit that you are not an attorney it might be wise to not pretend that you can give legal opinions.

- Incidentally people are arrested and prosecuted for impersonating law enforcement officers and military officers quite often -

- If you doubt this - feel free to contact attorney Mark Levin - who just happens to be a FReeper holdonnow

Mark is often known as F. Lee Levin on El Rushbo's show.....
