Biden at least knows how to play the political game. He’s been in it for a while. Does B. Hussein Obama even have 200 working days in the IL AND US Senates?

That would be up to the electoral college if this is ruled on before dec 15.

I’m not sure that SCOTUS can control (remove) a candidate from the ticket... they can only rule him ineligible, basically warning electors that if they vote for that ticket, the election itself will in the long run be nullified. We would have to start all over again.

This would leave the McCain-Palin ticket pretty much un-opposed in the EC... JUST LIKE Obama ran unopposed in most of his career elections. Poetic justice!

The EC is something that normally doesnt get very much attention. This time it will be different if SCOTUS actually defends the constitution.

It depends not only on how they rule, but when.

If the final ruling comes before the Electoral College votes, there are several possibilities. IMO, the most likely outcome of that would be President-elect Biden, though McCain is a possibility.

If they rule after the EC votes, but before 1/20/09, then we would have Acting President Biden on Jan 20. There doesn’t appear to be any enabling legislation giving authority to qualify a President if that were to happen, so we’d probably have Acting President Biden for four years. There also doesn’t appear to be any way for an Acting President to choose a VP.

But, and this is a huge but, if the USSC rules AFTER 1/10/09 that Obama is not qualified, then I have no idea what happens. THAT would be a true Constitutional crisis.

Most of this comes from Amendment XX, BTW.

Anything that damages the DNC is good for America.

If it proves they elected a fraud, it would indict everyone that supported him and the fact that they gave him such a free-pass (mainly because he doesn't look like the presidents on the currency, in his own words).

If Obama is seen by the Supreme Court as ineligible, or if just enough doubt is cast, it could cripple him, and that is good.

If he does have to step aside, it wouldn't matter which Democrat ascends, there will be no credibility whatsoever. The big bullet will remain in the bleeding foot for the next four, and perhaps more years.

Biden would be better. He would be completely ineffective. He has no perceived mandate and no starry-eyed cult followers. Plus he is just a doofus who nobody takes seriously.

  I heard the last Donofrio interview and he said that McCain is also not eligible. I looked at my pocket Constitution and 'natural born' isn't defined. I suppose everyone knew what it meant at the time it was written. The Supreme Court could study the matter and decide on the real meaning of 'natural born.' If both are disqualified, then I suppose the whole election would be invalid.

I don't think so; Obama not only hasn't been inaugurated yet...technically, he hasn't even been elected, since the electors have not yet voted.

It is unclear what would happen if he were found to be ineligible.

That is definately not true. He may be deemed elected as VP, or the DNC may be found to have failed to field a legitimate candidate, in which case Biden who was chosen by Hussein, is also inelligible, but a president will still have to be chosen by the electors, from the field of candidates.

It is my understanding that the entire ticket would be disqualified. Thus, McCain / Palin could still be in there.
