I'll play a hunch that Justice Souter did do this. He would be smart to do so, but I'm not up on court process. If I remember correctly -- it only takes one judge to reach out to take a case.

Look at it this way -- what is the greater Constitutional crisis -- discovering the truth BEFORE or AFTER the next two dates of significance? Which puts more at risk?
