There are two separate distinct issues: One, citizenship; and two, eligibility to serve as President under the Constitution, Article II, Sec. 1, Par. 4.
As to citizenship, McCain is in better shape that Obama; McCain has the two Citizen-parent rule, he is in without regard to how long or where questions.
The Senate passed a resolution intended to support McCain on the Constitutional question--unfortunately for him, the Senate can't unilaterally amend the Constitution. And McCain's best case was that under a Congressional fiction, the Canal Zone was U S Territory--among the other problems, McCain wasn't born there; he was born off the base in Panama. Most important, Congressional fictions don't control the meaning or application of the U S Constitution.
If the case gets to the Supreme Court, McCain also is not qualified to serve as President.
The only point I was making was in response to the claim that Obama is automatically a citizen because his mother is and that it didn’t matter where he was born. Obviously it matters, because of the question regarding McCain’s place of birth.
I, for one, would love a primary ‘do over’.
So what's the down side? If that is correct, then good...so be it, then we can start the election over again with new and hopefully better candidates. We're all holding our nose voting for McCain anyway. The main purpose to get this info out about Barack is to prevent the Manchurian Candidate from taking office and that is well worth the cost of a do-over.
