They CAN'T. They can prosecute for election fraud and falsification of official documents, and the judge may or may not decide to release the true documents.
But due to the right to privacy they can't release his documents without his permission or a court order.

The professor who filed an FOIA request made the argument that under HI statute, they could and should release his certificates and other supporting records because it is a unique matter of vital public interest. It would not set a precedent for the rest of us.
